Welcome to Motor+ Studio! The terms “we”, “us” and “our” refer to Motor+ Studio. Motor+ Studio operates this online store and website, including all related information, content, features, tools, products, and services, to provide you with a curated shopping experience (the “Services”). Motor+ Studio is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (together with any policies referenced or linked herein, the “Terms of Service” or “Terms”) describe your rights and responsibilities when using our Services. To use our Services – including browsing our online store or purchasing any products or services – you may be asked to provide certain information such as your name, email address, billing details, payment information, and shipping address. You represent and warrant that all information you provide is correct, current, and complete, and that you have all necessary rights to provide such information.

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to keep your username and password confidential and to notify us immediately of any unauthorized use of your account. Motor+ Studio will not be liable for any loss or damage arising from your failure to safeguard your account information. However, the colors, images, or details you see on your screen may differ slightly from the actual product due to differences in display devices or settings. All product descriptions and pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to modify or discontinue any product or service at any time.

We may also limit the quantities of any products or services that we offer to any person, geographic region, or jurisdiction on a case-by-case basis. Any offer for any product or service made on the site is void where prohibited.

Section 3 – Orders

When you place an order through our online store, you are making an offer to purchase the product(s) in your cart. All orders are subject to acceptance by Motor+ Studio. We reserve the right, at our sole discretion, to accept or decline any order for any reason. Your order is not deemed accepted until we provide confirmation (e.g. via an order confirmation email). We must receive and successfully process your payment before an order is accepted and shipped. Please review your cart and order details carefully before submission, as we may not be able to accommodate change or cancellation requests once an order is accepted. In the event we make a change to or need to cancel an order, we will attempt to notify you using the e‑mail, billing address, and/or phone number provided at the time the order was made.

Your purchase is subject to our Refund/Return Policy [LINK] for information on returns, exchanges, or refunds. You represent and warrant that your purchase is for your own personal or household use only and not for commercial resale, distribution, or export. In addition, Motor+ Studio may, in its sole discretion, limit or cancel quantities purchased per person or per order. We further reserve the right to refuse or cancel any order that, in our judgment, appears to be placed by dealers, resellers, distributors, or otherwise violated the “personal use only” condition. This is to prevent unauthorized resale or any use of our products for commercial purposes without our consent.

Section 4 – Prices and Billing

All prices for products and services are shown in the currency stated on our website and are exclusive of any applicable taxes, duties, shipping, or handling fees, unless otherwise noted. Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time you place your order, as reflected in your order confirmation email/receipt. Promotional or sale pricing may be subject to additional terms and may be limited to certain periods or quantities. If there is a conflict between the terms of a promotion and these Terms, the promotional terms will govern for that specific promotion.

You agree to provide current, complete, and accurate purchase and account information for all orders. This includes promptly updating your account information (email address, billing address, shipping address, payment card numbers and expiration dates, etc.) so that we can process your transactions and contact you as needed.

By submitting payment information, you represent and warrant that: (i) the credit or debit card information and other payment details you provide are true, correct, and complete; (ii) you are duly authorized to use the provided payment method; (iii) charges incurred by you will be honored by your financial institution (such as your credit card company); and (iv) you will pay all charges in accordance with the applicable prices, including any shipping fees, handling charges, and taxes. If your payment method is declined or your payment is otherwise insufficient, we may cancel your order and may contact you for an alternative payment method.

Section 5 – Shipping and Delivery

Motor+ Studio will arrange for shipment of the products to you. Shipping and delivery timelines provided at checkout or on our website are estimates only and not guaranteed. Actual delivery times may vary due to availability of products, carrier constraints, customs clearance (for international orders), or other unforeseen factors. Once we hand over the product(s) to the carrier for shipping, title and risk of loss pass to you. This means that you will be responsible for any loss or damage to the items after they have been delivered to the carrier.

We are not liable for any delays in shipping or delivery, or for any loss or damage caused by events beyond our control, including delays by the carrier, customs processing delays, or other logistics issues. If a package is refused or undeliverable due to an error in the address you provided or because you failed to accept delivery, you may be responsible for any return shipping fees and will not be refunded the original shipping charge.

Section 6 – Intellectual Property

The Services (including this website and all of its content and materials) are owned by Motor+ Studio or its affiliates and licensors, and are protected by the intellectual property laws of the United Arab Emirates and other international jurisdictions. This includes all text, designs, graphics, logos, images, audio/video clips, downloads, interfaces, code, and the overall selection, arrangement, and presentation of such content. All product names, brand names, logos, and related images or materials are either our property or used with permission. These works are protected by copyright, trademark, patent, and other intellectual property laws.

We grant you a limited, non-transferable, and revocable license to access and use the Services for your own personal, non-commercial use, in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works from, publicly display, perform, republish, download, store, or transmit any of the material on our Services without our prior written permission, except for incidental caching or as necessary to view the content. Except as expressly provided in these Terms, no license or rights under any copyright, trademark, patent, or other intellectual property of Motor+ Studio or any third party are granted to you. Unauthorized use of the Services or any content therein may violate applicable intellectual property laws and these Terms. All rights not expressly granted to you in these Terms are reserved by Motor+ Studio and its licensors.

Motor+ Studio’s name, logos, product and service names, designs, and slogans are trademarks or service marks of Motor+ Studio or its affiliates. You must not use any of these marks without the prior written permission of Motor+ Studio. All other product names, logos, and trademarks on our Services are the property of their respective owners (including Shopify’s name and logo), and are used on our site only to refer to those companies or their services. Nothing in these Terms grants you any right or license to use any third-party trademarks displayed on the Services.

From time to time, we may provide you with access to third-party tools or plugins that we do not monitor, control, or input. For example, our site might enable certain third-party services or widgets to enhance your experience. You acknowledge and agree that we provide access to such tools “as is” and “as available”, without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools accessed through our Services.

Any use by you of optional tools offered through the Services is entirely at your own risk and discretion. It is your responsibility to ensure that you review and approve the terms and conditions which apply to those third-party tools provided by the relevant provider(s).

Section 8 – Third-Party Links

This might include embedded content, plug-ins, or external links (for example, payment gateways or social media links). If you click on a third-party link and leave our site, you understand that: (a) we have no control over that third-party site and are not responsible for the content or accuracy of information on such sites; and (b) your interactions on those third-party sites are governed by their own terms and policies, not ours.

We are not liable for any harm or damages related to your visit to or use of any third-party websites, nor for any purchase or use of goods, services, or content from third-party sites. If you choose to access any third-party links or services, you do so at your own risk. Please review the third parties’ own terms of service and privacy policies before engaging in any transaction. Any complaints, claims, concerns, or questions regarding products or services provided by a third party should be directed to that third party, not to Motor+ Studio.

Section 9 – Relationship with Shopify

(Note: Shopify is the e-commerce platform we use to power our online store.) Motor+ Studio is powered by Shopify, which provides the e-commerce platform enabling us to sell products and services to you. However, any sales or purchases you make via our store are directly between you and Motor+ Studio. Shopify is not a party to the transaction. By using our Services, you acknowledge and agree that Shopify is not responsible for any issues arising from your purchase from Motor+ Studio, including but not limited to product quality, delivery, warranties, or any injury, damage, or loss related to products or services you purchase from our store. You hereby expressly release Shopify and its affiliates from any and all claims, damages, and liabilities arising out of or in any way connected with your transactions with Motor+ Studio.

Section 10 – Privacy Policy

Your submission of personal information through the Services is governed by our Privacy Policy (available at [LINK]), which describes how we collect, use, and protect your personal data. By using the Services, you acknowledge that you have read and understood our Privacy Policy. Additionally, because our store is hosted on Shopify’s platform, some of your personal information may be collected or processed by Shopify in accordance with Shopify’s Privacy Policy (available on Shopify’s website). For example, information necessary to process payments or manage the website’s functionality might be handled by Shopify’s systems.

By using our Services, you consent to the collection, use, and transfer of your information as outlined in our Privacy Policy. Specifically, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, translate, distribute, and display any such Feedback for any purpose, whether commercial or otherwise, without compensation to you. We may use your Feedback, for example, to improve our products or Services, develop new features, or promote our business.

You represent and warrant that you own or have the necessary rights to any Feedback you provide and that providing your Feedback does not violate any third-party rights. If you received any compensation or incentive from a third party in exchange for your Feedback (for example, if you were paid to write a review or testimonial), you agree that you have disclosed that fact to us. You further agree that your Feedback will comply with these Terms and all applicable laws.

We are not obligated to monitor, edit, or remove Feedback, but we reserve the right to do so if any Feedback, in our sole discretion, is unlawful, offensive, threatening, libelous, defamatory, obscene, or otherwise objectionable, or violates any party’s intellectual property or these Terms of Service.

You agree that you will not submit Feedback that violates any rights of a third party (such as copyrights, trademarks, privacy or personality rights) or contains any libelous, abusive, or unlawful material. You will also not upload any Feedback that contains viruses, malware, or other harmful code that could impact the operation of the Services. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties about the origin of any Feedback. You are solely responsible for any Feedback you submit and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third party.

Occasionally there may be information on our website or within the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. While we strive for accuracy, errors or inaccuracies may occur. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information in the Services (or on any related website) is inaccurate at any time without prior notice. This includes after you have submitted your order.

We undertake no obligation to update, amend, or clarify information in the Services or on any related website, including without limitation pricing information, except as required by law. No specified update or refresh date applied on our site should be taken to indicate that all information on the site or on any related service has been modified or updated at that time.

Section 13 – Prohibited Uses

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services (including our website and any of its content):

(a) For any unlawful, fraudulent, or malicious purpose, or to engage in any activity that would constitute a criminal offense or give rise to civil liability.
(b) To violate any applicable laws or regulations. This includes, without limitation, the federal laws of the United Arab Emirates, the local laws of the Emirate of Dubai, and any international or other laws applicable in your jurisdiction or ours.
(c) To infringe upon or violate our intellectual property rights or the rights of others (including copyrights, trademarks, patent rights, trade secrets, privacy rights, or other proprietary rights).
(d) To harass, abuse, insult, harm, defame, slander, intimidate, or otherwise harm any of our employees, customers, or other individuals.
(e) To submit false or misleading information.
(f) To upload, transmit, or share any material that does not comply with these Terms or that is illegal, offensive, obscene, or otherwise objectionable (including content that is pornographic, hateful, or incites violence).
(g) To send or facilitate the sending of any unsolicited promotional material or spam (including “junk mail,” “chain letters,” or any other similar solicitation).
(h) To impersonate or attempt to impersonate Motor+ Studio, any of our employees, another user, or any other person or entity, or falsely state or misrepresent your affiliation with any person or entity.
(i) To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which, as determined by us, may harm Motor+ Studio, Shopify, or users of the Services or expose them to liability.

Additionally, you agree not to:

(i) Upload or transmit any worms, viruses, malware, or any code of a destructive nature that could affect the functionality or security of the Services, our website, or any related system or the Internet.
(ii) Reproduce, duplicate, copy, sell, resell, exploit, or make unauthorized use of any portion of the Services, including the website’s content, without express written permission from us (this does not restrict legitimate personal use of our products purchased, but refers to misuse of our site and content).
(iii) Collect or track the personal information of others without authority (for example, through scraping, data mining, or any form of unauthorized data extraction from our site).
(iv) Use any robot, spider, crawler, scraper, or other automated means to access the Services for any purpose without our express written permission, or bypass any measures we may use to prevent or restrict access to the Services.
(v) Interfere with or circumvent the security features of the Services, our website, or any related network, or otherwise attempt to disrupt the Services or the networks or systems connected to the Services (for example, through hacking, denial-of-service attacks, or any other interference).

We reserve the right to suspend or terminate your access to the Services immediately and without notice if you violate any of the above prohibitions or any other term of these Terms. In addition, we reserve the right to take appropriate legal action for any illegal or unauthorized use of our Services.

Section 14 – Termination

We may terminate or suspend your access to our Services (in whole or in part) at any time, without prior notice, if you breach any of these Terms of Service or if we suspect that you have breached any term or are engaging in conduct that we believe is harmful to our interests, other users, third parties, or the integrity of the Services. We also reserve the right to terminate the Services or any part of them, or to cease operations entirely, at any time at our sole discretion.

If this agreement is terminated for any reason, the obligations and liabilities of the parties that have accrued before the termination date shall survive. In other words, even after termination, you will remain responsible for any payments due (if applicable) and for any damages that arise from your breaches of these Terms.

The provisions of these Terms which by their nature should survive termination (including but not limited to provisions regarding Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and others that impose obligations continuing beyond termination) shall continue to apply even after termination of this agreement and/or your use of the Services.

Section 15 – Disclaimer of Warranties

The information and content presented on or through the Services are made available for general information purposes only. While we strive to provide quality content, we do not warrant the accuracy, completeness, or usefulness of any information on the Services. Any reliance you place on such information is strictly at your own risk. We are not responsible or liable if information made available via the Services is not accurate, complete, or current.

EXCEPT AS EXPRESSLY PROVIDED BY MOTOR+ STUDIO IN WRITING, THE SERVICES AND ALL PRODUCTS AND CONTENT OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” without any representation, warranty, or condition of any kind, either express or implied. This includes, without limitation, all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

We do not guarantee, represent, or warrant that your use of our Services will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from use of the Services will be accurate or reliable, or that any errors in the Services will be corrected. You agree that from time to time we may remove or disable the Services (or any part thereof) for indefinite periods or cancel the Services at any time, without notice to you, where necessary.

Some jurisdictions do not allow the exclusion or limitation of certain warranties. If those laws apply to you, some or all of the above disclaimers may not apply, and you may have additional rights under the laws of your jurisdiction.

Section 16 – Limitation of Liability

To the fullest extent permitted by applicable law, Motor+ Studio and our parent company (if any), partners, officers, directors, employees, agents, contractors, suppliers, service providers, and licensors (and Shopify and its affiliates, to the extent they might be deemed liable) shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from or related to: (a) your use of the Services or any products procured via the Services; or (b) any other claim related in any way to your use of the Services or any product.

This means that we will not be responsible for, among other things: lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise. This limitation applies even if we have been advised of the possibility of such damages.

In particular, and without limiting the generality of the foregoing, Motor+ Studio will not be liable for any errors or omissions in any content on the Services, any reliance you place on that content, any interruption or cessation of transmission to or from the Services, any bugs, viruses, or the like that may be transmitted to or through our site by any third party, and any loss or damage of any kind incurred as a result of the use of any content or product posted, transmitted, or otherwise made available via the Services.

If, notwithstanding the foregoing, Motor+ Studio is found liable to you for any damage or loss arising out of or in any way connected with your use of the Services or any product, our aggregate liability shall in no case exceed the amount you paid us for the product or service that is the subject of the claim. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions our liability is limited to the maximum extent permitted by law.

Section 17 – Indemnification

You agree to indemnify, defend, and hold harmless Motor+ Studio and its affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees (as well as Shopify and its affiliates) from any claim, demand, losses, liabilities, damages, or expenses (including reasonable attorneys’ fees) made by any third party due to or arising out of: (1) your breach of these Terms of Service or any documents or policies incorporated by reference; (2) your violation of any law or regulation, or the rights of a third party; or (3) your use of the Services (including any products purchased, your user content, and your activities on the website).

We will promptly notify you of any such third-party claim and, if you request in writing, will provide reasonable assistance (at your expense) in the defense of the claim. We reserve the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with our defense of such claim). You agree not to settle any matter without the prior written consent of Motor+ Studio. This indemnification obligation will survive the termination of these Terms and your use of the Services.

Section 18 – Severability

In the event that any provision of these Terms of Service is determined to be unlawful, invalid, or unenforceable under applicable law, that provision shall be deemed severed from these Terms (only to the minimum extent necessary) and shall not affect the validity and enforceability of the remaining provisions. The rest of the Terms of Service will remain in full force and effect.

If any unlawful, invalid, or unenforceable provision would be enforceable or valid if some part of it were modified or removed, the provision shall apply with whatever modification is necessary to make it valid and enforceable to the fullest extent permitted by law.

Section 19 – Waiver and Entire Agreement

The failure of Motor+ Studio to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. Any waiver by us of any provision of these Terms must be made in writing and signed by an authorized representative of Motor+ Studio to be effective.

These Terms of Service, along with any policies or operating rules posted by us on this site or in respect to the Services (such as our Privacy Policy, Refund Policy, etc.), constitute the entire agreement and understanding between you and Motor+ Studio governing your use of the Services. They supersede any prior or contemporaneous agreements, communications, or proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party. You acknowledge that you have not relied on any representation, warranty, or statement not expressly set out in these Terms.

Section 20 – Assignment

You may not assign, transfer, or delegate these Terms of Service or any of your rights or obligations hereunder without our prior written consent. Any attempt to do so without consent will be null and void. Motor+ Studio may freely assign or transfer these Terms and our rights and obligations at any time, in whole or in part, without notice or consent. These Terms will be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.

Section 21 – Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Arab Emirates and, to the extent applicable, the laws of the Emirate of Dubai, without regard to conflict of law principles.

You and Motor+ Studio agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service or your use of the Services (including non-contractual disputes or claims) that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates. By using the Services, you consent to venue and personal jurisdiction in the Dubai courts for the purpose of litigating any such dispute.

(For customers residing outside the UAE: you may also have rights under mandatory consumer protection laws in your country of residence. Nothing in this Governing Law section affects any rights you might have that cannot be waived under those laws.)

Section 22 – Headings

Headings and section titles in this agreement (such as “Section 22 – Headings”) are included for convenience and organization only. They do not affect the interpretation of these Terms and will not limit or otherwise influence the meaning of any provisions of this agreement.

Section 23 – Changes to Terms of Service

You can review the most current version of these Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms of Service at our sole discretion. If we make material changes to these Terms, we will notify you by posting an updated version with a new “Last Updated” date, and/or by additional means as required by applicable law (for example, via email or a notice on our homepage). It is your responsibility to check our website periodically for updates to the Terms. Your continued use of or access to the Services after any changes to the Terms are posted constitutes acceptance of those changes.

If you do not agree with any change to the Terms, you must stop using the Services. No amendment or modification to these Terms will be binding unless posted by us as described above or explicitly agreed by us in writing.
